Terms of Service

1. Acceptance of Terms

By accessing or using SiteWatch ("the Service"), operated by Akhene Studio ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SiteWatch is a web monitoring platform that checks the availability, performance, security, and SEO health of websites. The Service includes automated monitoring, alerts, and reporting features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Free Trial

New accounts receive a 14-day free trial with access to all features. No credit card is required. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your monitors will be paused and your data retained for 30 days.

5. Subscriptions and Payments

Paid plans are billed monthly or annually in EUR via Stripe. Prices are displayed on our pricing page and may be updated with 30 days notice. All payments are non-refundable except as required by applicable law.

You may cancel your subscription at any time through the billing page. Cancellation takes effect at the end of the current billing period.

6. Right of Withdrawal (EU)

If you are a consumer in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason. To exercise this right, contact us through the application. If you have actively used the Service during this period, a pro-rata amount may be retained.

7. Fair Use

The Service is intended for monitoring websites you own or manage. You agree not to:

• Use the Service to monitor websites without authorization
• Attempt to overload target websites through excessive monitoring
• Resell or redistribute monitoring data without permission
• Use the Service for any illegal purpose

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for any losses resulting from service interruptions.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process monitoring data (HTTP responses, DNS records, SSL certificates) from the websites you add to the Service.

10. Limitation of Liability

SiteWatch is provided "as is". We do not guarantee that monitoring will detect all issues or that alerts will be delivered without delay. Our total liability for any claim related to the Service shall not exceed the amount you paid in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time, which will permanently remove all your data.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by French law. For EU consumers, mandatory consumer protection laws of your country of residence apply in addition. Disputes shall be submitted to the competent French courts, without prejudice to your right to bring proceedings in your country of residence.
